Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you ("you" or "User") and CatchAFace, a HadalCore product ("CatchAFace," "we," "us," or "our"), governing your access to and use of catchaface.comand related websites, applications, and services (collectively, the "Service").

By accessing or using the Service — including browsing, creating an account, uploading a photo, running a search, unlocking results, purchasing credits, or using monitoring — you agree to these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

These Terms were drafted in English. Any translation is for convenience only; the English version controls in case of conflict.

1. What CatchAFace is (and is not)

CatchAFace is a face-search engine and search interface. You upload a photo (a "Probe Image"). We compare the face in that image against publicly available images and return ranked similarity matches that link to third-party source pages.

CatchAFace is not a publisher. We do not create, host, edit, or operate the original webpages shown in results. We do not operate a public people directory, do not publish CatchAFace profile pages about individuals, and do not control the content of third-party websites. Matches are search results, not statements we author about any person.

The Service may also include optional features such as credit-based unlocks, search history, Privacy Receipts, sponsored teaser searches, and face monitoring / watchlist rescans, as we make them available from time to time.

2. Definitions

• Account means a registered CatchAFace user account tied to your email or sign-in provider.
• Credits means prepaid search unlocks or entitlements purchased through our payment provider.
• Match or Result means a candidate image or source URL returned by a search, ranked by estimated visual similarity.
• Monitoring means an optional feature that retains an enrollment image (with your consent) to rescan for newly indexed public appearances.
• Probe Image means the photo you upload to run a search or enroll monitoring.
• Restricted Region means any location where the Service is not offered under Section 5.

3. Eligibility and capacity

You represent and warrant that:

• you are at least 18 years old;
• you have the legal capacity to enter into these Terms;
• you are not located in, and will not use the Service from, a Restricted Region; and
• you will not upload images that depict anyone under 18, and you will not use the Service to search for or identify a minor.

If we reasonably believe you do not meet these requirements, we may suspend or terminate access without notice.

4. Acceptance; electronic agreement

You consent to form this agreement electronically and to receive notices electronically (including by email to your Account address or by posting in the Service). Electronic records satisfy any legal writing requirement to the fullest extent permitted by law.

5. Regional availability

Face search is currently offered only in the United States. It is not available outside the United States (including Canada, the European Economic Area, and the United Kingdom). Within the United States, face search is not offered in Illinois, Texas, Washington, Oregon, or Colorado (each a "Restricted Region"). Informational pages of the website may remain reachable so visitors can review policies and educational content; the geo-restriction applies to face-search functionality.

You may not run face searches if you are located in a Restricted Region, and you may not search for a person located in a Restricted Region. We may use IP address, account information, and other signals to enforce these limits. Circumventing geo-restrictions (including via VPN or proxy) is a material breach and may result in immediate suspension, forfeiture of unused Credits without refund, and deletion of related data.

6. Accounts and security

Some features require an Account. You agree to provide accurate registration information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your Account.

Notify us promptly at support@catchaface.com if you suspect unauthorized access. We may require email verification, multi-factor authentication, or other security checks. We are not liable for losses caused by unauthorized use of your Account if you failed to safeguard credentials or notify us promptly.

One person should use one Account unless we expressly approve otherwise. You may not sell, rent, or transfer your Account or Credits except as we expressly allow.

7. License to use the Service

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, lawful use (or internal business use if you are an organization using the Service on your own behalf), solely as permitted by these Terms.

This license does not include any right to:

• copy, modify, or create derivative works of the Service;
• reverse engineer, decompile, or attempt to extract source code or models, except where such restriction is prohibited by law;
• scrape, spider, harvest, or systematically extract data from the Service;
• use robots, bots, or automated means to access the Service except through interfaces we expressly provide;
• resell, white-label, or commercially redistribute the Service or Results without our prior written consent; or
• remove proprietary notices or attempt to bypass technical limitations, rate limits, paywalls, or geo-blocks.

All rights not expressly granted are reserved by CatchAFace and its licensors.

8. Probe Images, consents, and your responsibilities

Before each search (or monitoring enrollment), you must confirm that:

• the Probe Image shows you, or a person who has given you permission to run the search / enroll monitoring;
• you are 18 or older and the Probe Image does not depict a minor; and
• you will use Results only for lawful personal-safety, identity verification, or other purposes permitted by these Terms and applicable law.

You are solely responsible for the Probe Images you upload, the accuracy of your consents, and your subsequent use of Results. You represent that you have all rights and permissions needed to upload the Probe Image and to authorize us (and our processors) to process it to provide the Service.

For ordinary searches, we design the Service to delete the uploaded Probe Image after matching completes, as described in the Privacy Policy. Monitoring enrollments retain a reference image while active, because rescans require it. See the Privacy Policy for retention details.

9. License you grant us to process uploads

Solely to operate the Service, you grant CatchAFace a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit, and display Probe Images and related metadata as needed to run searches, generate Results, enforce these Terms, provide support, secure the Service, and comply with law. This license ends when we delete the applicable data under our retention practices, except for copies retained as required for legal, security, or dispute-resolution purposes.

We do not claim ownership of your Probe Images. We do not sell your Probe Images.

10. Permitted uses

Subject to these Terms, you may use the Service for lawful purposes such as:

• checking where your own face appears publicly online;
• personal safety or verification when you have permission to search the person shown;
• reviewing publicly available sources linked in Results; and
• using educational Opt-Out Guides to understand third-party removal processes.

You remain solely responsible for ensuring your specific use is lawful in every applicable jurisdiction.

11. Prohibited uses

You agree not to use the Service to, or in furtherance of:

• stalking, harassing, threatening, intimidating, doxing, blackmailing, extorting, or surveilling any person;
• searching for, identifying, or targeting a minor;
• non-consensual intimate imagery, revenge porn, or sexual exploitation;
• employment, housing, credit, insurance, or any other purpose covered by the Fair Credit Reporting Act (FCRA) or similar laws;
• unlawful discrimination, or decisions that deny rights or benefits based solely on CatchAFace Results;
• violating any person's privacy, publicity, intellectual property, or other rights;
• impersonation, fraud, identity theft, or social-engineering attacks;
• scraping, bulk harvesting, training competing models, or building an alternate face index from the Service;
• interfering with or degrading the Service, including denial-of-service attacks, malware, or abuse of rate limits;
• circumventing geo-blocks, bans, unlocks, paywalls, or security controls; or
• any other illegal purpose under applicable law.

CatchAFace is not a consumer reporting agency, and Results are not consumer reports. We may monitor for abuse, investigate reports, suspend or ban Accounts, revoke Credits, delete data, and cooperate with law enforcement.

12. Search results, accuracy, and lookalikes

Results are ranked by estimated visual similarity. A similarity score is not proof of identity. Many people look alike. Twins, relatives, lookalikes, edited photos, filters, AI-generated images, low-quality crops, and coincidental visual neighbors can all produce high scores. A strong percentage means faces are visually similar under our models — not that a Result is definitely the same person.

You acknowledge that:

• Results may be incomplete, outdated, duplicated, or wrong;
• the absence of a Result does not mean an image is not online;
• index coverage changes over time, so the same Probe Image may yield different Results later;
• we do not guarantee that any particular website, platform, or image will be searchable; and
• you must open source pages, compare context yourself, and treat every Match as an unverified lead until independently confirmed.

Results should not be your sole basis for any personal, legal, financial, safety, or business decision.

13. Third-party content and links

Results may include links, thumbnails, or references to third-party websites and images. Those materials are owned and controlled by third parties. We do not endorse, verify, or assume responsibility for third-party content, availability, legality, or privacy practices. Your use of third-party sites is at your own risk and governed by their terms.

Removing a Result from CatchAFace (where available) does not remove the original image from the source website. Educational Opt-Out Guidesexplain other companies' published processes; unless we expressly offer a takedown product, we do not submit removal requests on your behalf.

14. Credits, payments, and refunds

Certain features require Credits or other paid entitlements. Credit packs and prices are shown at purchase (see Pricing). Payments are processed by our payment provider as merchant of record; we do not store full card numbers. Taxes may be collected by the payment provider where applicable.

Credits are personal to your Account, have no cash value except as required by law or our Refund Policy, and are consumed when used to unlock Results or otherwise as described at purchase. Unused Credits generally do not expire unless we state otherwise at purchase, but we may reclaim Credits obtained fraudulently or in violation of these Terms.

Sponsored or promotional searches, if offered, may be limited (for example, one per account/device), may show locked teasers until unlock, and may be withdrawn or modified at any time.

Refunds are governed by our Refund Policy. Except as stated there or required by law, all purchases are final once Credits are used.

15. Monitoring / watchlist

If you enroll Monitoring, you authorize us to retain the enrollment image and related baseline data and to run periodic rescans against publicly available sources. You may remove a monitor subject to product controls. Monitoring does not guarantee detection of every new appearance. We may limit the number of monitors, rescan frequency, or eligibility by plan.

16. Intellectual property

The Service — including software, models, interfaces, trademarks, logos, documentation, and compilation of Results presentation — is owned by CatchAFace, HadalCore, or our licensors and protected by intellectual property laws. Except for the limited license in Section 7, no rights are granted to you.

"CatchAFace," related marks, and the CatchAFace logo are trademarks of HadalCore or its affiliates. You may not use them without prior written permission.

17. Feedback

If you send ideas, suggestions, or feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them for any purpose without compensation or attribution, to the extent permitted by law.

18. Privacy

Our collection and use of personal information is described in the Privacy Policy. By using the Service, you acknowledge that policy.

19. Enforcement, suspension, and termination

We may investigate suspected violations and take action we deem appropriate, including warnings, rate limits, feature restrictions, Account suspension or ban, Credit forfeiture, deletion of Probe Images or history, and reports to law enforcement or rights holders.

You may stop using the Service at any time. You may request Account deletion as described in the Privacy Policy. We may terminate or suspend the Service or your access at any time, with or without cause, and with or without notice, to the extent permitted by law.

Upon termination, your license ends immediately. Sections that by their nature should survive (including ownership, disclaimers, limitations of liability, indemnification, arbitration, and governing law) will survive.

20. Reporting misuse

If you believe someone is misusing CatchAFace, contact support@catchaface.com or use our contact form. We may request information needed to investigate. We do not guarantee a particular outcome or response time.

21. Changes to the Service

We may modify, suspend, or discontinue any part of the Service (including features, pricing, providers, or index coverage) at any time. We are not liable for any modification, suspension, or discontinuation to the extent permitted by law.

22. Changes to these Terms

We may update these Terms from time to time. We will post the revised Terms with an updated "Last updated" date. Material changes may also be communicated by email or in-product notice when appropriate. Except where required otherwise by law, changes become effective when posted. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service and close your Account.

23. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, we do not warrant that: (a) the Service will be uninterrupted, secure, or error-free; (b) Results will be accurate, complete, current, or useful for your purpose; (c) defects will be corrected; or (d) the Service will meet your expectations.

Some jurisdictions do not allow certain warranty disclaimers; in those jurisdictions, disclaimers apply to the fullest extent permitted.

24. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CATCHAFACE, HADALCORE, AND THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY; ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR RESULTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

The limitations in this section apply regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and are a fundamental basis of the bargain.

25. Indemnification

You agree to defend, indemnify, and hold harmless CatchAFace, HadalCore, and their affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service or Results; (b) your Probe Images or other content; (c) your violation of these Terms; (d) your violation of any law or third-party right; or (e) your misuse of Matches or disclosure of another person's information.

26. Dispute resolution; arbitration; class-action waiver

Informal resolution. Before filing a claim, you agree to contact us at support@catchaface.com and attempt to resolve the dispute informally for at least thirty (30) days.

Binding arbitration. Except for disputes that qualify for small-claims court or claims for injunctive relief regarding intellectual property or unauthorized use of the Service, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in the United States, and judgment on the award may be entered in any court with jurisdiction.

Class-action waiver. YOU AND CATCHAFACE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

Opt-out. You may opt out of arbitration within thirty (30) days of first accepting these Terms by emailing support@catchaface.com with your name, Account email, and a clear statement that you opt out of arbitration. If you opt out, or if arbitration is found unenforceable, Section 27 (governing law and venue) applies to court proceedings.

Nothing in this section prevents either party from seeking temporary injunctive relief in court to stop unauthorized use of the Service or intellectual property infringement.

27. Governing law and venue

These Terms and any dispute arising out of them are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration agreement.

Subject to Section 26, exclusive venue for permitted court proceedings lies in the state or federal courts located in the United States, and you consent to personal jurisdiction there.

28. Export and sanctions

You may not use the Service if you are subject to U.S. sanctions or appear on any U.S. government denied-party list, or for any purpose prohibited by U.S. export or sanctions laws.

29. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets, or by operation of law. These Terms bind permitted successors and assigns.

30. Miscellaneous

• Entire agreement. These Terms, the Privacy Policy, and the Refund Policy are the entire agreement between you and us regarding the Service and supersede prior agreements on that subject.
• Severability. If any provision is held unenforceable, the remaining provisions remain in effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
• No waiver. Failure to enforce a provision is not a waiver of the right to enforce it later.
• No third-party beneficiaries. These Terms do not create third-party beneficiary rights, except as expressly stated for indemnified parties.
• Force majeure. We are not liable for delays or failures due to causes beyond our reasonable control.
• Headings. Headings are for convenience only and do not affect interpretation.
• Relationship. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.
